Eanet, PC Files Wage and Hour/Misclassification Class Action On Behalf of California Care Givers Against Mae Morgan Agency

The proposed class action, filed in the Superior Court for the County of Los Angeles, challenges many of the practices of Jhan, Inc. doing business as the “Mae Morgan “Agency (as well as those of related persons and entities), including  alleged misclassification of caregivers as “independent contractors”, failure to pay minimum wages, failure to pay overtime, failure to reimburse for business expenses, and failure to provide itemized wage statements.  The claims have also been brought under California’s Private Attorney General Act (PAGA).

**Update-August 17, 2018**

On August 17, 2018, Judge Elihu Berle denied defendant Jhan, Inc.’s Motion to Compel Arbitration, finding that the arbitration agreement was both procedurally and substantively unconscionable.
